OrvellaTV Membership Service Agreement
1. Agreement and Incorporation
This Membership Service Agreement is a legally binding agreement between you and OrvellaTV concerning your purchase, access, and use of paid membership benefits within the OrvellaTV streaming entertainment service. This Agreement supplements the OrvellaTV Terms of Use, Privacy Policy, app store purchase disclosures, and any membership details presented at the point of purchase. If there is a conflict between this Agreement and the general Terms of Use regarding membership-specific matters, this Agreement will govern those membership-specific matters to the extent of the conflict.
By purchasing, activating, renewing, restoring, or using an OrvellaTV membership, you acknowledge that you have read, understood, and agreed to this Agreement. If you do not agree, you must not purchase or use membership benefits.
2. Membership Nature
OrvellaTV membership is an optional paid service designed to enhance your viewing experience. Membership may provide reduced advertising interruptions, access to download supported titles for offline viewing, and other viewing-related benefits expressly displayed in the app or purchase interface. Membership is not a purchase of ownership in any movie, series, program, file, software, brand asset, or audiovisual work.
Membership grants a limited, revocable, non-exclusive, non-transferable, personal right to access eligible membership features during the active membership period, subject to this Agreement, content availability, technical requirements, licensing restrictions, regional limitations, device compatibility, and applicable platform rules.
3. Membership Plans and Purchase Disclosures
Available membership plans, prices, billing cycles, renewal terms, trial availability if any, and included benefits may vary by country, platform, device, account status, promotional arrangement, and operational decision. Before purchase, you should carefully review the plan name, price, subscription duration, renewal terms, taxes, platform account used for purchase, and cancellation method shown by the app store or authorized payment interface.
We strive to display membership information clearly. However, where a purchase is completed through Apple App Store, Google Play, or another authorized platform, the final transaction screen, platform subscription settings, and platform receipts may constitute controlling transaction records for price, billing cycle, renewal date, taxes, and payment method.
4. Membership Benefits
Membership benefits may include reduced advertising interruptions during eligible viewing sessions and download access for supported titles. These benefits are subject to title-level licensing, platform constraints, app version, device storage, network availability, regional rights, content protection measures, and your continued compliance with this Agreement. Some messages may still appear, including service notices, legal notices, account messages, sponsorship disclosures, platform-required messages, content availability notices, and safety or support communications.
Download benefits apply only to titles that are technically and contractually enabled for download. Not every title, season, episode, language version, subtitle file, quality level, or device will support download. Downloaded content remains protected service content and may be viewable only inside the OrvellaTV app during the applicable authorization period.
5. Account Eligibility and Personal Use
You must have legal capacity to purchase and use membership in your jurisdiction. Membership is intended for personal, non-commercial entertainment use. You may not resell, rent, lend, sublicense, share as a commercial service, or otherwise monetize membership access. You are responsible for maintaining control of your account, device, app store account, and payment authorization method.
If we reasonably determine that a membership account is being used for fraud, unauthorized sharing, automated access, scraping, public exhibition, commercial screening, content extraction, or other prohibited activity, we may suspend or terminate membership access, subject to applicable law and platform rules.
6. Subscription Billing and Renewal
Membership may be offered as an auto-renewing subscription. If you purchase an auto-renewing plan, your membership will renew automatically at the end of each billing period unless cancelled before the applicable renewal date through the relevant platform or subscription management channel. The billing cycle, renewal price, and renewal date are shown at checkout or in your app store subscription settings.
Payment may be charged to your Apple App Store, Google Play, or other authorized platform account upon confirmation of purchase and upon each renewal. Taxes, currency conversion, payment authorization, receipts, platform fees, refund channels, and payment failure handling may be managed by the platform through which you purchased.
7. Cancellation and Expiration
You may cancel your membership through the subscription management tools provided by the platform through which you purchased the membership. Cancellation usually prevents future renewal but does not necessarily provide an immediate refund or immediate termination of current-period access. Unless the platform states otherwise, you may continue using paid benefits until the end of the current billing period.
Deleting the OrvellaTV app, stopping use of the Service, logging out, or uninstalling the app generally does not cancel a platform subscription. You must cancel through the appropriate app store or authorized subscription management interface to prevent future renewal charges.
8. Refunds and Billing Issues
Refund eligibility may depend on the platform through which you purchased, applicable law, purchase history, usage status, technical issues, and platform policy. If your purchase was made through Apple App Store or Google Play, refund requests may need to be submitted through that platform. OrvellaTV may not have authority to issue refunds directly for platform-managed transactions.
If you believe you were charged incorrectly, did not receive an active membership after payment confirmation, or experienced a technical entitlement issue, contact us at galvostudio@163.com with relevant non-sensitive details such as account identifier, purchase platform, approximate purchase time, and transaction status. Do not send full payment card numbers or unnecessary sensitive information.
9. Trials, Promotions, and Offers
OrvellaTV may offer promotional pricing, introductory periods, bundles, regional offers, or trials where permitted. Eligibility may be limited by account, device, platform, region, prior purchase history, campaign rules, or abuse-prevention controls. Trial or promotional terms will be disclosed before activation where applicable.
Unless otherwise stated at the time of enrollment, a promotional or trial membership may convert to a paid subscription at the end of the promotional period if you do not cancel before the renewal or conversion date. You are responsible for reviewing the applicable platform disclosures and managing cancellation in time if you do not wish to continue.
10. Benefit Changes and Content Availability
OrvellaTV may change, add, suspend, or discontinue membership benefits for legitimate operational, legal, licensing, technical, security, commercial, or platform compliance reasons. Content catalogs and download eligibility may change without individual notice because streaming rights are time-limited and region-specific. A title available today may become unavailable later, and download rights may expire or be withdrawn pursuant to licensing or technical requirements.
Where a material change substantially reduces a core paid benefit during your current paid period, we will handle the matter in a commercially reasonable manner, which may include notice, service adjustment, platform-directed remedy, or other response required by applicable law.
11. Download Rules
Downloaded content is provided for temporary offline viewing inside the OrvellaTV app. It may be subject to device limits, title limits, quality limits, storage limits, expiration periods, account verification, and periodic internet connection requirements. Downloaded content may become unavailable if your membership expires, your account is suspended, the title leaves the catalog, licensing rights change, the app is updated, the device is changed, or security checks cannot be completed.
You must not copy, extract, record, transfer, edit, upload, distribute, sell, publicly perform, publicly display, reverse engineer, or circumvent protection applied to downloaded content. Any attempt to bypass content protection or download restrictions may result in termination of membership access and other remedies available under law.
12. Advertising Reduction Limitations
Reduced advertising interruptions mean that eligible members may experience fewer standard advertising placements within the Service. It does not mean that all forms of messages, placements, content notices, sponsorship identifiers, product communications, compliance notices, or platform-required disclosures will be removed. Certain content may include embedded sponsorship, contractual notices, or rights-holder messages that cannot be removed by membership status.
We may also display account-related, technical, legal, service, security, or customer support communications to members because such communications are not treated as ordinary advertising for purposes of the membership benefit.
13. Prohibited Conduct
You may not use membership benefits to engage in unlawful, abusive, deceptive, infringing, or commercially exploitative conduct. Prohibited conduct includes account resale, shared commercial access, unauthorized public performance, automated viewing, artificial engagement manipulation, payment fraud, chargeback abuse, circumvention of geographic or technical restrictions, content extraction, interference with advertising systems, and use of the Service in violation of third-party rights.
We may investigate suspected violations and may cooperate with platforms, payment processors, licensors, service providers, and lawful authorities where reasonably necessary to protect the Service, enforce this Agreement, or comply with law.
14. Platform Terms
Your membership purchase may be subject to Apple, Google, or other platform terms in addition to this Agreement. Platform terms may govern billing authorization, subscription renewal, cancellation process, refund requests, family sharing availability if any, tax treatment, payment method updates, and account-level subscription records. If platform terms provide mandatory consumer protections, those protections remain available to you.
OrvellaTV is not responsible for platform outages, app store account restrictions, payment method decline, platform refund decisions, or subscription management errors outside our reasonable control. We will, however, use commercially reasonable efforts to help verify membership entitlement where we receive sufficient lawful transaction information.
15. Suspension and Termination
We may suspend or terminate membership access if you violate this Agreement, violate the Terms of Use, create security risk, misuse downloads, interfere with service integrity, engage in fraud, infringe rights, or use membership benefits in a manner inconsistent with lawful personal viewing. Suspension or termination may affect access to reduced advertising interruptions, downloads, member-only functions, and related account features.
Where required by applicable law, we will provide appropriate notice or opportunity to remedy. However, we may act immediately where necessary to prevent harm, preserve security, comply with law, protect licensors, or stop unauthorized content access.
16. Disclaimers
Membership benefits are provided on an “as available” basis to the maximum extent permitted by law. We do not warrant that membership access will be uninterrupted, errorless, available in every country, compatible with every device, or that every content item will support downloads or reduced advertising. Network conditions, device storage, platform controls, licensing restrictions, app updates, and third-party services may affect the membership experience.
Nothing in this Agreement excludes warranties or rights that cannot be excluded under applicable consumer law. Where exclusions are limited by law, they apply only to the maximum permitted extent.
17. Limitation of Liability
To the maximum extent permitted by law, OrvellaTV and its affiliates, licensors, contractors, service providers, officers, and employees shall not be liable for indirect, incidental, special, consequential, punitive, exemplary, or lost-profit damages arising from membership purchase, renewal, cancellation, content unavailability, download expiration, advertising display, platform billing operations, or inability to access membership benefits.
Except where prohibited by law, our aggregate liability relating to membership shall not exceed the amount you paid for the affected membership period during the three months preceding the event giving rise to the claim.
18. Changes to This Agreement
We may update this Agreement to reflect changes in membership features, platform rules, commercial practices, legal requirements, technology, security needs, or operational structure. The updated version will be identified by a revised effective date. Where required by law or where changes materially affect existing paid benefits, we may provide additional notice through the app, email, platform notice, or another reasonable method.
Your continued use of membership benefits after the updated Agreement becomes effective constitutes acceptance of the updated terms, subject to any mandatory consent or notice requirements under applicable law.
