OrvellaTV Content Access Agreement
1. Scope and Future Applicability
This Content Access Agreement governs any future feature through which OrvellaTV may allow users to obtain paid access to specific eligible movies, series, episodes, programs, events, collections, or other digital video content within the OrvellaTV service. This Agreement supplements the OrvellaTV Terms of Use, Privacy Policy, Membership Service Agreement, Auto-Renewal Agreement where applicable, app store disclosures, and purchase terms displayed at checkout.
This Agreement does not create a current obligation for OrvellaTV to offer paid single-title access, premium title access, event access, or any similar feature. If the feature is not available in your app version, country, device, account, or platform, this Agreement serves only as a preparatory legal framework for future use.
2. No Ownership Transfer
Paid content access is a limited digital viewing license, not a sale of ownership. You do not acquire title, copyright, distribution rights, reproduction rights, public performance rights, public display rights, editing rights, sublicensing rights, or any other proprietary interest in the content. All content remains owned or controlled by OrvellaTV, its affiliates, licensors, studios, producers, distributors, or other rights holders.
Unless expressly stated otherwise at purchase, access is personal, non-commercial, revocable, non-exclusive, non-transferable, and limited to viewing through the authorized OrvellaTV app or service environment during the applicable access period.
3. Purchase Display and Material Terms
Before any paid content access transaction is completed, OrvellaTV or the applicable platform should display material terms, including the content title or category, price, currency, tax treatment where available, access duration, viewing limitations, platform account used for purchase, refund channel, device restrictions, download availability if any, and any expiration rules. You are responsible for reviewing all purchase information before confirming payment.
If the displayed terms conflict with this Agreement for a specific purchase, the more specific checkout disclosure will govern that purchase to the extent it is lawful and not inconsistent with mandatory consumer protection rules.
4. Payment Platform and App Store Rules
Where paid access is offered inside an app distributed through Apple App Store, Google Play, or another app marketplace, payment processing may be subject to the applicable platform rules for digital content and in-app purchases. The platform may control payment authorization, tax calculation, receipt delivery, refund process, payment method management, purchase restoration, and transaction records.
OrvellaTV may rely on platform-provided entitlement data to determine whether content access has been successfully purchased, restored, refunded, revoked, expired, or otherwise modified. You must comply with the applicable platform terms in addition to this Agreement.
5. Access Period and Expiration
Content access may be limited by a fixed viewing window, rental period, event period, catalog availability period, account status, geographic availability, licensing restriction, or technical entitlement period. The applicable access period should be shown before purchase. Once the access period expires, you may lose the ability to view the content, even if you previously started viewing or downloaded a supported file.
OrvellaTV may also remove or restrict content where required by law, rights-holder instruction, platform rule, court order, content protection requirement, safety concern, or technical necessity. We will handle material access issues in a commercially reasonable manner and in accordance with applicable consumer protection rules.
6. Download and Offline Viewing
If a paid content access purchase includes download functionality, downloaded content is provided solely for temporary offline viewing inside the authorized OrvellaTV environment. Download availability may be limited by title, device, region, storage, quality, subtitle version, account status, security checks, app version, and license terms.
You may not copy, extract, record, transfer, edit, upload, distribute, sell, publicly perform, publicly display, reverse engineer, or circumvent protection applied to downloaded content. Downloaded content may expire, become unavailable, or require periodic online verification.
7. Compatibility and Technical Requirements
Access to purchased content may require a compatible device, supported operating system, current app version, stable internet connection, valid account status, active app store account, sufficient storage, and successful platform entitlement verification. Playback quality may vary based on network conditions, device capability, content encoding, regional content delivery performance, and platform restrictions.
OrvellaTV does not guarantee that every item will be available in every resolution, subtitle option, audio language, download format, or device environment. Technical limitations do not transfer ownership rights or create a right to circumvent service protections.
8. Geographic and Licensing Restrictions
Digital content rights are often limited by territory, time period, language, platform, and distribution channel. A title available for access in one country may not be available in another. Access may change if you travel, change account region, use a device from another market, or access the Service through a platform with different rights rules.
You must not use proxy tools, false location information, unauthorized technical measures, or account manipulation to bypass geographic or licensing restrictions. Such conduct may result in access suspension, purchase revocation where permitted, account action, or other lawful remedies.
9. Refunds and Failed Entitlements
Refund eligibility depends on the platform through which the purchase was made, applicable law, access status, playback history, technical issue, content availability, and platform policy. For app store purchases, refund requests may need to be submitted through Apple, Google, or the relevant platform. OrvellaTV may not have authority to issue direct refunds for platform-controlled transactions.
If payment succeeds but content access is not delivered, you should contact us at galvostudio@163.com with non-sensitive details such as account identifier, platform, approximate purchase time, title name, and transaction status. We may verify the entitlement and, where appropriate, restore access, provide technical support, refer you to the platform, or take another commercially reasonable action.
10. Relationship With Membership
Membership benefits and paid content access may be separate. A membership subscription may reduce advertising interruptions or enable downloads for supported titles, but it does not automatically include access to every future premium title, event, special program, early access item, or separately priced content unless the purchase screen or membership description expressly states otherwise.
If a member receives a discount or special access offer, the offer may be subject to additional eligibility rules, region limits, time limits, platform restrictions, and abuse-prevention controls. Membership cancellation or expiration may affect member-only discounts or related access benefits.
11. Prohibited Conduct
You must not resell, rent, lend, share for commercial gain, publicly screen, redistribute, scrape, extract, record, upload, modify, create derivative works from, or otherwise exploit purchased content access. You must not interfere with digital rights management, watermarking, account controls, entitlement checks, device limits, download restrictions, playback restrictions, or regional controls.
Fraudulent purchases, chargeback abuse, unauthorized account use, payment manipulation, automated access, credential sharing for commercial use, and attempts to obtain access without valid authorization may result in suspension, termination, entitlement revocation, cooperation with platforms or payment providers, and other remedies available under law.
12. Content Changes and Removal
OrvellaTV may modify content metadata, artwork, subtitles, audio tracks, quality options, playback format, availability windows, and related user interface information for operational, legal, licensing, safety, or technical reasons. In limited cases, content may be removed or replaced after purchase due to rights-holder requirements, legal claims, platform policy, safety review, or technical defects.
Where removal materially affects a paid access right that remains within its valid access period, OrvellaTV will handle the issue in a commercially reasonable manner, which may include restoration, replacement, platform referral, credit where legally and operationally available, or other remedy required by applicable law.
13. Account Security and Unauthorized Purchases
You are responsible for securing your device, account credentials, app store account, purchase authentication settings, and payment authorization tools. If another person uses your account or device to make a purchase, you may be responsible for the charge unless applicable law or platform policy provides otherwise.
You should use platform password controls, biometric purchase confirmation, family purchase settings, device locks, and account security tools to prevent unauthorized purchases. If you suspect unauthorized access, contact the relevant platform and notify us at galvostudio@163.com.
14. Privacy and Purchase Data
OrvellaTV may process account identifiers, device information, purchase entitlement data, content access records, playback status, support communications, and technical diagnostics to verify access, provide playback, prevent fraud, process support requests, comply with legal obligations, and improve the Service. Our processing of personal information is described in the OrvellaTV Privacy Policy.
We generally do not receive full payment card numbers from app stores. Payment platforms may process payment credentials, tax information, receipts, refunds, and dispute records under their own terms and privacy policies.
15. Consumer Protection and Mandatory Rights
Nothing in this Agreement limits mandatory consumer rights that cannot be waived under applicable law. Depending on your jurisdiction, you may have rights concerning accurate price display, access to purchased digital content, remedies for non-delivery, refund review, unfair contract terms, and truthful advertising. OrvellaTV will interpret this Agreement in a manner consistent with applicable mandatory consumer protection rules.
Where a jurisdiction grants a cooling-off, withdrawal, cancellation, or refund right for certain digital content purchases, the availability and scope of that right may depend on whether access began, whether the content was consumed, whether you consented to immediate performance, and the rules of the platform through which the purchase occurred.
16. Suspension and Termination
We may suspend or terminate content access if you violate this Agreement, violate the Terms of Use, misuse content, interfere with security measures, infringe rights, commit fraud, abuse refunds, or create legal or operational risk. Suspension may affect current access periods, downloads, playback, account status, and future purchase eligibility.
Where immediate action is not required, we may provide notice or support review. However, we may act without prior notice where necessary to prevent harm, comply with law, protect rights holders, maintain platform compliance, preserve security, or stop unauthorized access.
17. Disclaimers
Paid content access is provided on an “as available” basis to the maximum extent permitted by law. OrvellaTV does not warrant uninterrupted playback, indefinite catalog availability, compatibility with every device, permanent access, availability in every region, or support for every subtitle, language, quality, or download option. Content access may be affected by licensing restrictions, platform entitlement delays, technical failures, network conditions, app updates, or device limitations.
Some jurisdictions do not allow certain disclaimers. In those jurisdictions, this section applies only to the maximum extent permitted by law.
18. Limitation of Liability
To the maximum extent permitted by law, OrvellaTV and its affiliates, licensors, service providers, officers, employees, and contractors shall not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages arising from paid content access, content unavailability, playback interruption, download expiration, platform billing operations, purchase restoration delays, or rights changes.
Except where prohibited by law, OrvellaTV’s aggregate liability for a paid content access claim shall not exceed the amount you paid for the specific affected content access transaction giving rise to the claim.
19. Updates to This Agreement
We may update this Agreement to reflect changes in product design, content access models, platform rules, consumer protection requirements, payment operations, licensing practices, security controls, or business operations. The updated version will be identified by a revised effective date. Where required by law, we may provide additional notice or seek consent before applying material changes.
Your continued use of paid content access features after an updated Agreement becomes effective constitutes acceptance of the updated terms, subject to applicable mandatory rights and platform requirements.
